Yes, you can stop using that HDFC account and continue using another salary account. However, don’t ignore the negative balance completely. Usually, the negative amount happens due to auto-debit reversals, loan recovery attempts, penalties, or charges. Banks may continue recovery follow-ups and can report defaults linked to loans or credit cards. Dear Sir, A nominee is only a custodian, not the owner of the funds. As per Supreme Court rulings like Shakti Yezdani v. Jayanand Jayant Salgaonkar, the legal heirs have the actual rights over the assets if there is no Will. Banks may ask for NOCs from all legal heirs, but this is not mandatory by law it’s only for safety. If there is any dispute, a Succession Certificate may be required. Financial hardship: Inform the bank in writing (email) about your situation, including the cyber fraud loss. Keep proof. Settlement: Banks often insist on regular payment first, but you can still request settlement directly once the account becomes NPA (usually after 90+ days). Do not agree to anything you cannot afford. Important: Never take new loans to repay old ones. Negotiate calmly and only in writing. While, I'm facing too many calls but I pick only selective calls from lenders with a statement that "I am currently facing financial hardship, currently I'm not in position to pay. And it was working but yesterday I received a Fake Police call threatening me that a court case is filed against me at Allahabad High Court and if I'm unaware about that I need to talk to the lawyer with the number he told me. When I tried to ask him multiple time about the case, he threatened me that he will arrest me within 45 minutes. later, I received multiple calls from the same number (lawyer) that fake police officer provided me but I haven't picked. You are not required to go to the police station for a credit card default this is a civil matter, not a criminal offence. Your rights: -Recovery agents cannot threaten, harass, or defame you publicly. -Visiting your home and shouting in front of others is illegal harassment. -They cannot force payment or use police pressure tactics. What you should do: -Stay calm and do not sign or agree under pressure. -Record such visits (audio/video) as evidence. -Send a written complaint to the bank and escalate to RBI if needed. -You can also file a police complaint for intimidation and harassment.
